Eviction Process With Mosaic Property Management

Eviction Process

Our Rent Collection process is quick and efficient. If a tenant does not pay their rent on or before
the 1st of the month, it is considered late on the 2nd. Late fees begin to accrue.

If a tenant has not paid by the 5th of the month, the 5 Day Notice of Non Payment is sent certified mail
to the tenant. This begins the Eviction Process. That gives the tenant 5 Days mailing time and 5 Days
Notice time to get their payment to the office in certified funds, for all accrued costs; rent, tax,
late fees, notice fees, etc.

If they do not, on the 16th of the month, everything is sent to our eviction attorney to begin the eviction.
The court date is usually set within 5 – 7 business days, depending on that cities court schedule and case
volume. At the eviction proceeding is the last chance the tenant has to appear and pay in full, including
all court and lawyer fees. If they do not pay or appear in court, the eviction is processed and the tenant
has 5 calendar days to vacate the property.

In the rare case the tenant does not vacate the house within the 5 days, we issue what is called a Writ Of
Restitution. That goes to the city constable who contacts us to set a date and time to meet at the property
and remove the tenant. We have a locksmith on hand at the time and change all locks to protect your property.

Last step of an eviction is if personal property is left behind. We have to hold said property for a period
of time and allow a one time, scheduled meeting with the tenant to allow them to retrieve their belongings.
Once the house is vacant and cleaned up, we can re-list and find that great tenant you’ve been looking for.

The total cost to process an eviction through the courts averages $300 – $800. For under $100 annually or $8
per month, you can protect yourself from unforeseen costs.
Eviction Protection Plan – $96/year
Under the Eviction Protection Plan (EPP), Broker will pay the cost of all copy charges, filing fees, process
server fees, attorney fees, court costs, the costs of Broker or Broker’s representative to appear in court if
requested in connection with any “Special Detainer Action” or “Forcible Entry and Detainer” case filed to enforce
tenant compliance with their obligations under the lease agreement. If a Writ of Restitution is required to
enforce the legal order for possession; the court and attorney fees for such are also covered under this agreement.
Eviction Rent Loss Plan
We offer a Rent Loss Plan to provide up to 60 days of rent payments to help get through the Eviction
Process and difficult times of vacancy due to an evicted tenant.
- 30 day: 15% one month rent
- 60 day: 25% one month rent
Under the Eviction Rent Loss Plan (ERLP), Broker will pay to Owner the base rent amount as defined in the lease agreement
for a period not to exceed 60 days. Payment is only made to Owner if tenant is legally evicted under a “Special Detainer”
or “Forcible Entry and Detainer” and judgment is received.
